Storage period
Unless a more specific storage period is given in this privacy notice, your personal data stays with me until the purpose for processing it no longer applies. If you make a justified request for deletion or withdraw your consent to data processing, your data will be deleted unless I have other legally permitted reasons for storing it (for example retention periods under tax or commercial law); in that case, it is deleted once those reasons no longer apply.
General information on the legal bases for data processing on this website
If you have consented to data processing, I process your personal data on the basis of Art. 6(1)(a) GDPR, or Art. 9(2)(a) GDPR where special categories of data under Art. 9(1) GDPR are processed. If you have explicitly consented to the transfer of personal data to third countries, the processing is also based on Art. 49(1)(a) GDPR. If you have consented to cookies being stored or to information on your device being accessed (for example by device fingerprinting), the processing is also based on § 25(1) TDDDG. Consent can be withdrawn at any time. If your data is needed to perform a contract or to take steps before entering into one, I process it on the basis of Art. 6(1)(b) GDPR. I also process your data where this is needed to meet a legal obligation, on the basis of Art. 6(1)© GDPR. Processing may also be based on my legitimate interest under Art. 6(1)(f) GDPR. The legal basis that applies in each case is given in the following paragraphs of this privacy notice.
Recipients of personal data
In the course of my business, I work with various external bodies. In some cases this requires personal data to be passed on to them. I only pass personal data to external bodies if this is needed to perform a contract, if I am legally obliged to (for example passing data to tax authorities), if I have a legitimate interest under Art. 6(1)(f) GDPR in passing it on, or if another legal basis allows it. When I use processors, I only pass on my clients’ personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.
Withdrawing your consent to data processing
Many data processing operations are only possible with your explicit consent. You can withdraw consent you have already given at any time. Withdrawal does not affect the lawfulness of the processing carried out before it.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right at any time to object to the processing of your personal data on grounds relating to your particular situation; this also applies to profiling based on these provisions. The legal basis of each processing operation is given in this privacy notice. If you object, I will no longer process the personal data concerned unless I can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection under Art. 21(1) GDPR).
If your personal data is processed for direct marketing, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling insofar as it is connected with such direct marketing. If you object, your personal data will then no longer be used for direct marketing (objection under Art. 21(2) GDPR).
Right to complain to the competent supervisory authority
In the event of breaches of the GDPR, data subjects have the right to complain to a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged breach. This right exists without prejudice to other administrative or judicial remedies.
Right to data portability
You have the right to have data that I process automatically on the basis of your consent or to perform a contract handed over to you or to a third party in a common, machine-readable format. If you ask for the data to be transferred directly to another controller, this is only done where technically feasible.
Access, correction and deletion
Within the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the processing, and where applicable a right to have this data corrected or deleted. You can contact me at any time about this and any other questions on personal data.
Right to restriction of processing
You have the right to ask for the processing of your personal data to be restricted. You can contact me about this at any time. The right to restriction of processing applies in the following cases:
- If you dispute the accuracy of the personal data I hold about you, I usually need time to check this. For the duration of the check, you have the right to ask for the processing of your personal data to be restricted.
- If your personal data was or is being processed unlawfully, you can ask for the processing to be restricted instead of deleted.
- If I no longer need your personal data but you need it to exercise, defend or establish legal claims, you have the right to ask for the processing to be restricted instead of deleted.
- If you have objected under Art. 21(1) GDPR, your interests and mine must be weighed against each other. As long as it is not yet clear whose interests prevail, you have the right to ask for the processing of your personal data to be restricted.
If you have restricted the processing of your personal data, this data may, apart from being stored, only be processed with your consent, to establish, exercise or defend legal claims, to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.
SSL/TLS encryption
For security reasons and to protect the transmission of confidential content, such as enquiries you send to me as the site operator, this website uses SSL/TLS encryption. You can recognise an encrypted connection by the address in your browser starting with “https://”. When SSL/TLS encryption is active, the data you send to me cannot be read by third parties.
3. Hosting
Hetzner
This website is hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (“Hetzner”). The server is in a Hetzner data centre in Germany. It stores the server log files and the requests from the quote form described in section 4.
Hetzner is used on the basis of Art. 6(1)(f) GDPR. I have a legitimate interest in providing my website as reliably and securely as possible.
Hetzner makes a backup copy of the server every day; each backup is overwritten after 7 days. Data I have deleted on the server can therefore remain in these backups for up to 7 days longer.
Data processing agreement
I have concluded a data processing agreement with Hetzner. This is a contract required by data protection law which ensures that Hetzner processes my website visitors’ personal data only on my instructions and in compliance with the GDPR.
4. Data collection on this website
No cookies, no analytics, no third-party content
This website sets no cookies and stores nothing else on your device. It uses no analytics or tracking tools and loads no content from other servers: fonts, scripts, images and videos are all served from this server.
Server log files
The web server automatically collects and stores information that your browser sends automatically, in so-called server log files. These are:
- the address requested and the type of request
- browser type and version, and the operating system used
- other technical details your browser sends, for example your preferred language
- the time of the request
- the IP address, with its last part removed before it is stored (for IPv4 the last number, for IPv6 everything after the first 48 bits)
- details of the server’s response (status code, amount of data transferred, duration)
The page you came from (referrer URL) is not stored. This data is not combined with other data sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. I have a legitimate interest in presenting my website without technical errors and keeping it secure; the server log files are needed for this. They are deleted after 7 days at the latest.
Quote form
If you send me a request through the quote form, the details you enter are stored to handle the request and in case of follow-up questions. These are your name, email address, organisation, role, type of organisation, the service you are interested in and your message, and, if you fill them in, format, deadline, number of variants, budget range and how you found me. Your request is emailed to me and also stored as a backup in a database on the server, together with the date, time and the language of the page. I do not pass this data on without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your request relates to the performance of a contract or is needed for steps before entering into one. In all other cases, the processing is based on my legitimate interest in handling the requests sent to me effectively (Art. 6(1)(f) GDPR) and on the consent you give in the form (Art. 6(1)(a) GDPR); consent can be withdrawn at any time.
To protect the form against masses of automated submissions, your IP address is held in the server’s working memory to limit repeated requests, and discarded about one hour after your last submission. It is neither stored with the request nor logged. This is done on the basis of Art. 6(1)(f) GDPR; my legitimate interest is protecting the form against misuse. The form uses no cookies and no third-party services.
Requests stored in the database are deleted automatically after 365 days, or earlier if you ask. The email with your request stays with me until you ask me to delete it, withdraw your consent to its storage, or the purpose for storing it no longer applies (for example once your request has been dealt with). Mandatory legal provisions, in particular retention periods, remain unaffected.
Contact by email
If you contact me by email, your request, including all personal data it contains (name, request), is stored and processed by me to deal with your enquiry.
6(1)(f) GDPR).
The data you send me by email stays with me until you ask me to delete it or the purpose for storing it no longer applies (for example once your enquiry has been dealt with). Mandatory legal provisions, in particular statutory retention periods, remain unaffected.
Email provider
Emails to me, including those from the quote form, pass through the servers of my email provider mailbox.org, operated by Heinlein Hosting GmbH, Schwedter Straße 8/9A, 10119 Berlin, Germany. It is used on the basis of Art. 6(1)(f) GDPR; I have a legitimate interest in reliable and secure email communication. I have concluded a data processing agreement with Heinlein Hosting GmbH.
